**REVISION #1 DATED 2/9/15 IS TO PROVIDE QUESTIONS ASKED AND ANSWERS PROVIDED UNDER THE COMMENTS SECTION OF THIS BID POSTING** Cherokee Nation Entertainment, LLC is seeking bids from qualified Archtectural/Interior Design firm for the remodel/re-design of the Flint Creek Steakhouse and Bar located inside the Cherokee Casino & Hotel located in West Siloam Springs, OK. Cherokee Nation Entertainment ("CNE") will provide drawings of the existing layout upon request for reference only during the bidding process; more detailed drawings will be provided to the selected firm. There will be a MANDATORY pre-bid and walk through on Tuesday, February 3, 2015 at 3:00PM CST inside Flint Creek. SEALED bids will be due no later than 3:00PM CST on Friday, February 13, 2015. This is to be a LUMP SUM, not to exceed fee. All documents for this bid posting, including a Floor Plan drawing for Area 5 showing the lay-out of Flint Creek. Cherokee Nation Entertainment, LLC (“CNE”) reserves the right to issue one award, multiple awards, or reject all bids; any award is subject to the approval of the required funds. Responding bidders are not allowed to withdraw their bid for a period of 90 days after submittal. At the time of award, the successful bidder(s) will be required to work with the Cherokee Nation Entertainment, LLC Accounting department to discuss account coding for invoices. All bids are subject to negotiation prior to award. Awards may be issued without discussion of bid received, and bids should initially be submitted on the most favorable terms from a price and technical standpoint. Any award resulting from this RFP will be subject to CNE Terms and Conditions. Your bid should indicate hourly ($) rate (when applicable), individual work effort, delivery schedule or time of completion. Any item(s) with exceptions, substitutions, exclusions, additions or qualifications must be noted and clearly indicated on return bid. In accordance with Cherokee Nation Law, , 28 C.N.C.A. §20 no contractors or subcontractors of any Cherokee Nation entity may contract with any business owned by a first degree relative of any elected official of the Cherokee Nation. TRIBAL EMPLOYMENT RIGHTS OFFICE - This procurement is subject to Cherokee Nation Tribal Employment Rights Office (“TERO”) regulations that include a fee of ½ of 1% of total contract award and, if applicable, the completion of a TERO Labor Agreement and payment of associated fees. The successful bidder’s award will be published on the Cherokee Nation’s procurement website and their performance will also be measured, recorded, and reported to the Cherokee Nation. The complete Act is available by contacting the TERO OFFICE at Tahlequah 918-453-5000. TERO bidders are required to provide a copy, front and back, of their TERO certificate with return bid(s) and failure to do so will result in such bidders not receiving the TERO preferences afforded TERO bidders under the CNE procurement and contracting policies and procedures. CHEROKEE NATION GAMING COMMISSION (CNGC) - This requirement may be subject to CNGC policies and procedures. Licensing requirements may be required of the successful vendor(s) to be coordinated with the CNGC. These requirements may include licensing fees as well security and background checks of vendor(s) employees. BONDING NOTICE - CNE generally requires payment and performance bonds for all construction contracts in excess of $100,000. However, qualified TERO-certified firms are encouraged to bid, regardless of bonding capability. INSURANCE - CNB generally requires Worker’s Compensation, Commercial and/or Comprehensive General Liability, and Automobile insurance for all awarded bids. DEBARMENT - By submitting a response to this Request for Proposal, the Contractor certifies to the best of their knowledge and belief that the Subcontractor, the firm, or any of its principals are not presently debarred, suspended, or proposed for debarment by any federal, state, local or tribal entity. This certification is a material representation of fact upon which reliance was placed when making award. If it is later determined the Subcontractor rendered an erroneous certification, in addition to other remedies available to CNE or its entities, CNE may terminate the contract resulting from this Request for Proposal for default.

Currently Unavailable -- QUESTIONS: 1. Kevin mentioned the goal is to have the restaurant open 60 days from Tuesday, February 3rd, 2015. This would be Saturday, April 4th, 2015. Knowing more about the project, the process, expectations, and the Scope of Work, I created a hypothetical schedule, below. It is longer than the 60 days discussed on Monday. Is the 60 days a firm date? 02/03/15 = Prebid meeting 02/13/15 = Proposals due 02/16/15 = Short list complete and interviews scheduled (1 day) 02/20/15 = Interviews complete and design firm selected (4 days) 02/25/15 = Design services contract executed [Commence Work] (5 days) 03/18/15 = Schematic Designs [2 designs and 8 renderings complete] (3 weeks) 03/25/15 = SD Review & Approval (1 week) 04/08/15 = Design Development complete [1 design and 4 renderings] (2 weeks) 04/15/15 = DD Review & Approval (1 week) 05/01/15 = Construction Documents complete (2 weeks) 05/15/15 = GC Bidding/Bids due, unless pre-negotiated (2 weeks) 05/22/15 = Negotiations w/GC complete, unless pre-negotiated (1 week) 05/26/15 = Construction Start (4 days) 06/12/15 = Construction Complete (3 weeks) 06/13/15 = Open (1 day) 2. The discussion Tuesday was that walls/partitions will not be removed. Looking at the floor plan, however, the half-round booth seating abuts the curved walls. Replacing these curved booths with a standard booth & table layout will require selective demolition of the curved portion for the new booths to fit. Can these walls be removed? (Has there been any consideration of using 4-top square tables & chairs in lieu of booths and leaving the half-round walls?) 3. Regarding FF&E, booth seating can be a long lead item – eight weeks is average, and it could potential be a week or two longer. Quick-ship choices are generally limited in selection, kind, and quality of material choices. If 60 days is the expectation, the deadline to order is approaching quickly! 4. The RFP includes “initial” and “final” renderings. Can you please elaborate on the expectation for these renderings: something “conceptual” (showing general massing, color, and shapes) or more “photo-realistic” (showing specific patterns, colors, and specified furniture)? 5. Kevin made the comment that the bar and back-bar need to be replaced with a linear design in lieu of the current curved design. The ceiling and lighting in the bar area is very detailed and mimics the shape of the bar. Should demolition and redesign of the bar ceiling and lighting be included in the Scope of Work? ANSWERS: Schedule will be evaluated Curved walls can be removed We can used temp FF&E if necessary Initial is what you are presenting for approval final is what has been approved. Bar lighting can be revised to fit new bar or leave existing and add for straight bar. You decide.
