Cherokee Nation Businesses, LLC is seeking proposals to provide an option to its employees for electronic pay via pay card, as well as the option to electronically access check stubs, W-2's and leave accruals. The services of the selected pay card provider should reduce payroll costs and fees, decrease risk of paycheck fraud, and eliminate internal escheatment processes. Program features, requirements and key deliverables are as outlined in the RFP Document. All interested proposers are required to submit a signed Non-Disclosure Agreement, can be found as shown under the Documents section of this RFP, prior to receiving the RFP Document. A pre-bid conference call, if requested; will be held around 8/24/2016; the specific time will be provided if the pre-bid conference call is deemed necessary. The purpose of this call is to allow potential bidders to ask questions and make clarifications about the RFP. A signed Non-Disclosure Agreement must be returned to CNB prior to attending the pre-bid call. NDAs are due to Tina Jones via email by 5:00pm CST on 8/19/2016. If possible, submit your questions via email to tina.jones@cnent.com by 8/22/2016. Verbal questions will be taken on the call but it’s preferred to have a list of the questions prior to the call. The goal of this Request for Proposal (RFP) is to determine if your services meet the functional and technical needs of CNB. Please feel free to submit any additional information you deem appropriate for this project. Any CD/flash drive and/or user documentation submitted with your proposal will be returned upon written request. All other materials provided will become the property of CNB and will not be returned to the vendor. Vendors shall provide 5 hard copies of each proposal and then one copy via soft copy on flash drive/CD, etc. RFP submission: All proposals should be sent by express delivery, regular mail or hand delivery to CNB’s Catoosa Corporate office at the following address, to be received no later than 8/30/2016 by 2:00PM CST. Attn: Tina Jones 1102 N. 193rd East Ave., Bldg. #3 Catoosa, OK 74015 Bids shall be submitted at the time and place indicated and shall be enclosed in a sealed envelope, marked with the Project Title, RFP Number, Name and Address of the bidder, and accompanied by the other required documents. If the Bid is sent through the mail or other delivery system, the sealed envelope shall be enclosed in a separate envelope addressed to the Cherokee Nation Businesses, L.L.C., Attn: Tina Jones, with the notation “SEALED BID - DO NOT OPEN” on the face thereof. The attached “Non-Disclosure Agreement” document must be filled out in its entirety and returned via email prior to any questions being answered and prior to attending the pre-bid call. The Non-Disclosure Agreement must also be returned in the RFP response. Failure to return the Non-Disclosure document with bid prior to bid closing will result in disqualification of bid. RFP responses should include all requested information including the scope of the bid. This information will be held in confidence and will not be made available to other vendors. Likewise, the vendor agrees to hold in confidence any and all information included in this RFP and will not disclose to a third party any part of this RFP, except as necessary to generate a response to this RFP. CNB reserves the right to issue one award, multiple awards or reject any or all responses. CNB reserves the right to make partial awards, to award all work, to reject any and all bids, to waive any and all bid document requirements and to negotiate contract terms with the successful bidder, and the right to disregard all nonconforming, nonresponsive or conditional bids. Discrepancies between words and figures will be resolved in favor of words. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum. The vendor is responsible for all costs they incur in preparing their response to this RFP. The vendor may be asked to present their response on-site. TRIBAL EMPLOYMENT RIGHTS OFFICE - This procurement is subject to Cherokee Nation Tribal Employment Rights Office (“TERO”) regulations that include a fee of ½ of 1% of total contract award and, if applicable, the completion of a TERO Labor Agreement and payment of associated fees. The successful bidder’s award will be published on the Cherokee Nation’s procurement website and their performance will also be measured, recorded, and reported to the Cherokee Nation. The complete Act is available by contacting the TERO OFFICE at Tahlequah 918-453-5000. TERO bidders are required to provide a copy, front and back, of their TERO certificate with return bid(s) and failure to do so will result in such bidders not receiving the TERO preferences afforded TERO bidders under the CNE procurement and contracting policies and procedures. CHEROKEE NATION GAMING COMMISSION (CNGC) - This requirement may be subject to CNGC policies and procedures. Licensing requirements may be required of the successful vendor(s) to be coordinated with the CNGC. These requirements may include licensing fees as well security and background checks of vendor(s) employees. DEBARMENT - By submitting a response to this Request for Proposal, the Contractor certifies to the best of their knowledge and belief that the Subcontractor, the firm, or any of its principals are not presently debarred, suspended, or proposed for debarment by any federal, state, local or tribal entity. This certification is a material representation of fact upon which reliance was placed when making award. If it is later determined the Subcontractor rendered an erroneous certification, in addition to other remedies available to CNB or its entities, CNB may terminate the contract resulting from this Request for Proposal for default.
