**CM CLARIFICATION #1, DATED 3/24/17, IS AS FOLLOWS: Item #1 Bid Bonds should be made payable to Cherokee Nation; P.O. Box 948, Tahlequah, OK 74465. Item #2 The top of the building pad elevation will be at 99’ which is 1’-0” below the finish floor elevation shown at 100’. Item #3 Refer to the soils report description for the soil classification of the top two feet of building subgrade backfill material. Item #4 Reference Bid Package 3A – Building Concrete – The scope of work for this package includes all rock excavation required per the Bid Documents and indicated in the Soils Report. Item #5 Reference Bid Package 5A – Structural Steel – The scope of work for this bid package shall EXCLUDE the cost for the Avadek Canopy system. Item #6 Reference Bid Package 5A – Structural Steel – The scope of work for this bid package shall EXCLUDE the cost for the McNichols Eco-Mesh Panel system. **ADDENDA #2, DATED 3/23/17, IS TO ADDRESS BIDDER QUESTIONS AND TO RE-ISSUE AND CLARIFY DRAWINGS. All properly sealed and labeled proposals should be sent by express delivery, regular mail or hand delivered to Flintco; 1624 West 21st Street, Tulsa, OK 74107. The following bid packages are part of this first phase of bidding: ? Building Concrete ? Structural Steel All bids are to be sealed and CLEARLY labeled by describing the project and indicating the package being bid, on the envelope as described in the Instructions to Bidders. A Bid Security, as stipulated in the bid documents, in the amount of 5% of the bid may be required to accompany the sealed proposal of each bidder if the amount of the bid exceeds $100,000. The Owner and Construction Manager will conduct a pre-bid conference at the Cherokee Nation TERO Office; Address: 16836 Highway 10, Tahlequah, OK 74464 for the purpose of review of the bidding documents, bidding procedures and to receive Bidders' questions. The pre-bid conference is scheduled for Thursday, March 16, 2017 at 10:00am CST. All Bidders for this project are required to meet all qualification requirements as established in these bid documents. The Owner reserves the right to reject any or all bids or to waive any informalities or irregularities in the bidding. PROPOSAL PROCEDURE: A. The Bidder, by his failure to include every listed Items 2 through 10 above within the sealed envelope and label information as required in item 1, may forfeit his right to have his bid considered. TERO CERTIFIED BUSINESS PROCESS: A. Reference the attached document “An Act” for TERO requirements. Subcontractors are to EXCLUDE the cost for Section 5; Title 40, § 1011; T. Employee Rights Fee of ½%. This cost will be paid by the Construction Manager. B. Reference the attached TERO Statutory Requirements with the Project Labor Agreement and include all associated fees in the base bid for the project. Subcontractors are to EXCLUDE the cost for daily work permits of $25/day for each employee.
