**CHANGE ORDER #1, DATED 1/20/2021, IS TO REMOVE ORIGINAL SCOPE OF SERVICES PROVIDED AND INCLUDE THE REVISED SCOPE OF SERVICES** Cherokee Nation Entertainment, LLC (CNE) is seeking complete proposals from qualified architectural firms to provide complete design services for the remodel of the West Siloam Springs Cherokee Casino Buffet. The buffet venue is an approximate 10,000 square foot food venue. The Owner desires to renovate the space into a food hall concept, similar in look and feel to the included conceptual renderings. The architectural service provided under the scope of this RFP shall be to provide complete design and engineering services and drawings to allow for a competitive bid for construction services, as more clearly delineated in the Scope of Services provided. Due to the on-going issues with COVID-19 all bid package documents shall be filled out and e-mailed to Cherokee Nation Businesses at the following address: WSS_Buf.kjko7ezdf66qxztc@u.box.com to be received no later than February 4, 2021 by 5:00PM CST. Please notify Buyer, Tina Jones, when bid is sent so verification of receipt can be confirmed, DO NOT include a copy of your bid in your email. Any questions should be directed via email to Tina Jones at tina.jones@cnent.com. Any questions received two (2) days, or less, prior to bid closing will not be addressed and should be noted on return bid document as exclusions or exceptions. Please note that winning bid(s) will be published. Cherokee Nation Entertainment, LLC (“CNE”) reserves the right to issue one award, multiple awards, or reject all bids; any award is subject to the approval of the required funds. Responding bidders are not allowed to withdraw their bid for a period of 90 days after submittal. At the time of award, the successful bidder(s) will be required to work with the Cherokee Nation Entertainment, LLC Accounting department to discuss account coding for invoices. All bids are subject to negotiation prior to award. Awards may be issued without discussion of bid received, and bids should initially be submitted on the most favorable terms from a price and technical standpoint. Any award resulting from this RFP will be subject to CNE Terms and Conditions. Your bid should indicate hourly ($) rate (when applicable), individual work effort, delivery schedule or time of completion. Any item(s) with exceptions, substitutions, exclusions, additions or qualifications must be noted and clearly indicated on return bid. Any request for information concerning bid posting is to be submitted in writing via email to Buyer listed; no verbal communication is to be initiated. In accordance with Cherokee Nation Law, , 28 C.N.C.A. §20 no contractors or subcontractors of any Cherokee Nation entity may contract with any business owned by a first degree relative of any elected official of the Cherokee Nation. DEBARMENT - By submitting a response to this Request for Proposal, the Contractor certifies to the best of their knowledge and belief that the Subcontractor, the firm, or any of its principals are not presently debarred, suspended, or proposed for debarment by any federal, state, local or tribal entity. This certification is a material representation of fact upon which reliance was placed when making award. If it is later determined the Subcontractor rendered an erroneous certification, in addition to other remedies available to CNE or its entities, CNE may terminate the contract resulting from this Request for Proposal for default.

Tina Jones -- Questions submitted on 1/25/2021 with answers provided: 1. Is it possible to get an existing floor plan of the buffet as it exists today for our use in this RFP so that we can determine the extent of the rework as it would be extremely helpful? Not at this time. • It is difficult to get Food Service scope clarified without some understanding of what exists versus what the proposed design wants to be and the extent of work in the main kitchen. Current food venue is a 6 station buffet. The renovated space will resemble a food hall with 4-5 offerings as noted in the RFP. • It is difficult to get an understanding on what scope would be for structural without this existing layout. For the purpose of the RFP, structural services are to be excluded. Owner will carry a contingency to cover any necessary structural evaluations or design. Respondent shall provide an hourly rate schedule for structural should Owner elect to utilize respondent’s structural enegineer. 2. Will there be “as built” documents in AutoCAD or REVIT format as the basis of the starting point of the project. Although not specifically required we are assuming there will need to be a Field Verification site visit/effort to be included. Files are available in PDF format only. Field Verification of existing conditions is an expectation. 3. Can you please clarify and elaborate on the details and extent of the close out requirement for the “as-built/red line mark ups of the construction documents” Owner expects the A/E to assimilate and collate the contractor as-builts into final, clean PDF’s for recordkeeping. 4. What program is used for the current renderings since we are to modify these renderings? A/E will need to develop their own renderings based off the present as-built drawings and site reconnaissance. 5. Within the Phases – Design – Programming: It notes “based on provided renderings and estimates”. Please provide the project estimates as that was not currently included in the RFP to our knowledge. A/E shall submit with their renderings for consideration a project estimate. As progress develops and advances, A/E shall revise their estimate accordingly. Owner will provide project funding to the successful respondent once a contract has been executed. 6. Within the Phases – Design – Schematic & Design Development: It notes “Prepare and submit up to 3 sets of schematic design documents”. Is this 3 design options or allow 3 reviews to occur with ownership? Please clarify. Up to 3 design options. 7. What is required for physical samples for owner review? Materials Boards or Loose samples or digital presentations? Please clarify. Material boards reflecting the products exemplified in the presented renderings. 8. Is Purchasing Assistance required? We define Purchasing Assistance as the review of all FF&E items (communication with purchasing agent, review of shop drawings, finish samples, and CFAs) For the purpose of this RFP, purchasing assistance is required for those items de. 9. Confirm Procurement of FF&E items will occur in -house with CNB/WSS team. Confirmed. Owner will provide its own procurement. 10. Is FF&E Installation Assistance Required? We define Installation Assistance as the onsite coordination with the installer and purchasing agent of FF&E items For the purposes of this bid, project administration includes field visits to verify proper installation of all designed elements, including FFE designed under the contract.
