**CHANGE ORDER #1, DATED 7/16/18, IS TO REVISE BID CLOSING DATE; NEW BID CLOSING DATE IS NOW TUESDAY, JULY 24, 2018 AT 2:00PM CST** Cherokee Nation Businesses, LLC a wholly owned Tribal entity of the Cherokee Nation is seeking pricing proposals from independent and non-product affiliated security-consulting firms for the Scope of Work in Section III of the attached bid documents. SEALED proposals are to be returned no later than July 17th by 2:00PM CST and are to be returned in accordance with the bid instructions shown in the attached bid documents. All questions are to be sent via email to the Buyer and should be received no later than 7/9/18 by COB. Scope of Work Cherokee Nation Entertainment (CNE) is requesting pricing proposals from independent and non-product affiliated security-consulting firms with the following preferred qualifications: • A minimum of 5 (five) years’ experience conducting security assessments in a variety of industries, with an emphasis in casino and/or other similar hospitality venues. • Experience with security plan design and cost estimating. • Sufficiently qualified personnel to carry out the project in a timely fashion. • Preferably credentialed through the American Society of Industrial Security International (ASIS International) as a Certified Protection Professional (CPP) or Physical Security Professional (PSP) or Certified Security Consultant (CSC). • Must have experience conducting threat assessments on multi-level structures to perform a physical security risk and threat assessment for the 10 (ten) casino properties owned by CNE. This proposal should include a full assessment report, security plan to mitigate risk, and potential costs for recommended security improvements associated with the proposed security plan. The bidder must deliver a comprehensive security report that, at a minimum, include the following: 1. Identify security related threats from internal and external sources for all 10 (ten) CNE owned casinos. 2. Identify critical assets and pair threats to identify most likely scenarios in which to base the security plan. 3. Analyze vulnerabilities and assess impacts of threat scenarios. 4. Identify actions to mitigate risks and provide an analysis of mitigation actions. CNE requires, at a minimum, the following be included as part of this assessment: • A review of staffing models and staffing levels at each individual site • A physical evaluation of each individual site • A physical evaluation of all areas surrounding the individual facilities (i.e.: loading docks, parking lots, etc.) • Overall evaluation of security program (noting weaknesses and vulnerabilities) • Interviews with security staff (include proposed percentage of staff to interview at each site) • Evaluation of security policies and procedures • Evaluation of security training • A review of emergency response process/plan The selected consultant will deliver a Security Risk Assessment Report and cost estimate which will provide recommendations for: • Technical and physical security measures to mitigate risk to staff, information and CNE assets. • Modifications to security policy and procedures as appropriate. • Emergency response measures for critical events, to include but not limited to: o Bomb Threat o Active Shooter o Workplace Violence o Dignitary Protection o Evacuation Process (Severe Weather, Fire, Etc.) • Phased implementation strategies with cost estimates for recommended measures • Presentation(s) to management and other stakeholder groups to review findings and recommendations. This procurement is subject to the rules and regulations of the Cherokee Nation Tribal Employment Rights Office (“TERO”), as adopted and authorized by the Cherokee Nation Tribal Employment Rights Act (Title 40 of the Cherokee Nation Code Annotated). These rules and regulations provide for the assessment of a fee, where applicable, of ½ of 1% of the total contract award (including any and all subsequent additions and deletions to the contract award due to changes in the scope of the work);, the submission of a properly completed TERO Labor Agreement; and the assessment and payment of applicable labor fees. The successful bidder’s award will be published on the Cherokee Nation’s procurement website and their performance will be measured, recorded, and reported to the Cherokee Nation. The TERO rules and regulations that are applicable to the Work to be performed by the successful bidder will be determined and communicated by TERO and such rules and regulations shall be made a material term of the Contract Agreement. TERO bidders are required to provide a copy, front and back, of their TERO certificate with bid(s) and failure to do so will result in such bidders not receiving the TERO preferences afforded TERO bidders under the Company procurement and contracting policies and procedures. This procurement may be subject to Cherokee Nation Gaming Commission (“CNGC”) policies and procedures. In the event CNGC licensing is applicable, the successful vendor(s) shall be responsible for obtaining all licenses required by CNGC. CNGC licensing requirements may include licensing fees as well as security and background checks of vendor(s) employees.
