REQUEST FOR BID Cherokee Nation Entertainment, LLC, corporate office for the Cherokee Casinos,Hard Rock Casino, Will Rogers Downs, Outpost Tobacco Stores and The Outpost Convenience Stores, is accepting bids for 4th tier cigarettes for resale in its various outlets. Cherokee Nation Entertainment, LLC retail sites are located in Tahlequah, Ft. Gibson, Ramona, Roland, West Siloam Springs, Sallisaw, South Coffeyville, Grove, Claremore and Catoosa, Oklahoma. All stores with the exception of Will Rogers Downs in Claremore are licensed through the Cherokee Nation Tax Commission and are compacted under the Oklahoma Native American Tobacco Compact. Proof of licensing and authorization from the Cherokee Nation will be required with bid submission. Will Rogers Downs will be under the Oklahoma State Tax Commission. Bidders must submit licensing, authorizations or any other applicable proof. The successful bidder will: • Provide EDI electronic ordering capability • Electronic price upload capability • EFT capability • Dedicated salesman for account • Deliver a minimum of two times per week to each location. • Emergency delivery as required. • Prompt written notification of price change to include copies of notices from manufacturers • Assistance with store resets • Price protection on tobacco products • Provide all manufacturer rebates and special promotions • Provide proof of insurability including workman’s compensation, general liability and vehicle coverage. Cherokee Nation will be named as an additional insured. • Affix Native American Compact and Oklahoma tax stamp on all applicable tobacco products. • Compile and submit tax reports and taxes to the Cherokee Nation Tax Commission by the 15th of each month and Oklahoma State Tax Commission as required- an example of the excel format is available upon request. • Provide miscellaneous management reports as required by CNE • Provide CNE access to all applicable invoices, books and records for auditing purposes • Abide by CNE terms and conditions and the governing laws of the Cherokee Nation • Certified with PDI • Dedicated salesman on site for all cstores to assist with ordering on grocery and deli • Provide exact dollar information on taxes paid to the state for OTP and cigarettes no later than the 3rd business day of each month • Provide exact quantities reported to the state on cartons of cigarettes no later than the 3rd business day of each month • Provide velocity reports and tax information to CNE no later than the 3rd business day of each month • Provide wholesaler’s base cost on OTP so we can figure rebates provided to our tribe • Willingness to bring on new items as we request or to research and provide just cause why those items are not beneficial • Obtain a vendor gaming license • Send a full price book for tribal and state stores 2 times a week • Assist with labeling in stores • Capable of sending Electronic invoicing directly to our back office systems • Ability to attend events where new products or special promotions can be obtained 4th Tier Tobacco Berley Decade Eagle Echo Edgefield Fortuna Grand Prix Liggett Select Carnival Pyramid Sonoma Time USA Cheyenne ALL BIDS MUST CONTAIN A FLASH DRIVE WITH AN EXCEL DOCUMENTFORMAT FOR PRICING IN A SEALED ENVELOPE. Prices are applicable for a four year period unless provided notification of a manufacturer price increase. Please include all additional charges such as fuel surcharges, if applicable. Awards may be separated by category at the discretion of CNE. CNE retains the right to reject any and all bids. All proposals should be mailed or hand delivered to Owner’s Catoosa Corporate office at the following address, to be received no later than Monday, September 16th, 2019 at 3pm. It is the intention of Owner that if an acceptable proposal is received, the selected firm will be notified in writing within 10 business days of bid opening. Any bid received after the time set for opening of Bids, shall not be considered and will be returned. It is the intention of CNE that if an acceptable bid is received, the Contract will be awarded by within 30 days of bid opening. Please note that winning bid(s) will be published. CNE reserves the right to issue one award, multiple awards, or reject all bids. All bids are subject to negotiation prior to award. Awards may be issued without discussion of bid received, and bids should initially be submitted on the most favorable terms from price and technical standpoint. Any award resulting from thisProposal will be subject to CNE Terms and Conditions. Your bid should indicate hourly ($) rate (when applicable), individual work effort, delivery schedule or time of completion. Any item(s) with exceptions, substitutions, exclusions, additions or qualifications must be noted and clearly indicated on return bid. This procurement is subject to Cherokee Nation Tribal Employment Rights Office (“TERO”) regulations that include a fee of ½ of 1% of total contract award and, if applicable, the completion of a TERO Labor Agreement and payment of associated fees. The successful bidder’s award will be published on the Cherokee Nation’s procurement website and their performance will also be measured, recorded, and reported to the Cherokee Nation. TERO bidders are required to provide a copy, front and back, of their TERO certificate with return bid(s) and failure to do so will result in such bidders not receiving the TERO preferences afforded TERO bidders under the CNE procurement and contracting policies and procedures. CHEROKEE NATION GAMING COMMISSION (CNGC) - This requirement may be subject to CNGC policies and procedures. Licensing requirements may be required of the successful vendor(s) to be coordinated with the CNGC. These requirements may include licensing fees as well security and background checks of vendor(s) employees.
