**REVISION 2 DATED 1/29/14 IS TO INCLUDE INFORMATION ABOUT ELECTRICAL REQUIREMENTS; THESE ARE AS LISTED UNDER THE COMMENTS TAB** **REVISION 1 DATED 1/28/14 IS TO INCLUDE QUESTIONS AND RESPONSES UNDER THE COMMENTS TAB OF THIS POSTING** Cherokee Nation Entertainment, LLC is seeking bids from qualified General Contractors for the construction and procurement of a new 4,000sqft pre-engineered Facilities / Maintenance building for the Cherokee Casino in Roland, OK. The building will conform to the floor plan, site and elevation drawings developed by James Childers Architects. The work will consist of grading, draining and clearling areas for gravel road and building site, building pad and concrete, basic rough-in for sewer and water stubbed 5 ft. outside of building slab. Contractor is to provide conduit and electrical wiring to new building. This will be a lump sum, all inclusive bid. Bidder(s) must include a complete list of all sub-contractors noting their TERO status. SEALED bids will be due no later than 12:00PM CST on Tuesday, February 4, 2014. Bids can be sent via express mail or hand delivered. If sending via express mail, bids are to be delivered to: Cherokee Nation Entertainment, LLC, Attn: Tina Jones, 777 W. Cherokee St., Catoosa, OK 74015. If delivery bid(s) by hand, please deliver to Cherokee Nation Entertainment, Attn: Tina Jones, 1102 N. 193rd East Ave., Catoosa, OK 74015. SEALED envelope must clearly state SEALED BID - DO NOT OPEN and must show COMPANY NAME, ADDRESS, and TITLE OF BID. A bid check list is being provided for all of the required documents that are to be included in SEALED bid envelope; if any of these documents are NOT included, bid(s) will be disqualified. TERO bidders must include a copy, front and back, of their TERO certificate; if not included TERO preference will not be given. There will NOT be a mandatory pre-bid, however, bidders are strongly encouraged to visit the site to familiarize themselves with the site conditions. All drawings and bid documents are as listed under the DOCUMENTS tab of this posting. Please DO NOT contact the Architect direct with any questions, all questions are to be submitted to Tina Jones via email at tina.jones@cnent.com and must be received no later than 12:00PM CST on 1/29/14. Please note that winning bid(s) will be published. Cherokee Nation Entertainment, LLC (“CNE”) reserves the right to issue one award, multiple awards, or reject all bids; any award is subject to the approval of the required funds. Responding bidders are not allowed to withdraw their bid for a period of 90 days after submittal. At the time of award, the successful bidder(s) will be required to work with the Cherokee Nation Entertainment, LLC Accounting department to discuss account coding for invoices. All bids are subject to negotiation prior to award. Awards may be issued without discussion of bid received, and bids should initially be submitted on the most favorable terms from a price and technical standpoint. Any award resulting from this RFP will be subject to CNE Terms and Conditions. Your bid should indicate hourly ($) rate (when applicable), individual work effort, delivery schedule or time of completion. Any item(s) with exceptions, substitutions, exclusions, additions or qualifications must be noted and clearly indicated on return bid. Any request for information concerning bid posting is to be submitted in writing via email to Buyer listed; no verbal communication is to be initiated. TRIBAL EMPLOYMENT RIGHTS OFFICE - This procurement is subject to Cherokee Nation Tribal Employment Rights Office (“TERO”) regulations that include a fee of ½ of 1% of total contract award and, if applicable, the completion of a TERO Labor Agreement and payment of associated fees. The successful bidder’s award will be published on the Cherokee Nation’s procurement website and their performance will also be measured, recorded, and reported to the Cherokee Nation. The complete Act is available by contacting the TERO OFFICE at Tahlequah 918-453-5000. TERO bidders are required to provide a copy, front and back, of their TERO certificate with return bid(s) and failure to do so will result in such bidders not receiving the TERO preferences afforded TERO bidders under the CNE procurement and contracting policies and procedures. CHEROKEE NATION GAMING COMMISSION (CNGC) - This requirement may be subject to CNGC policies and procedures. Licensing requirements may be required of the successful vendor(s) to be coordinated with the CNGC. These requirements may include licensing fees as well security and background checks of vendor(s) employees. Current policies and procedures can be found on the Cherokee Nation website or by contacting the CNGC office at 918-207-3834. BONDING NOTICE - CNE generally requires payment and performance bonds for all construction contracts in excess of $100,000. However, qualified TERO-certified firms are encouraged to bid, regardless of bonding capability. INSURANCE - CNB generally requires Worker’s Compensation, Commercial and/or Comprehensive General Liability, and Automobile insurance for all awarded bids. Please refer to the Bid Documents for the specific coverages required for this bid. DEBARMENT - By submitting a response to this Request for Proposal, the Contractor certifies to the best of their knowledge and belief that the Subcontractor, the firm, or any of its principals are not presently debarred, suspended, or proposed for debarment by any federal, state, local or tribal entity. This certification is a material representation of fact upon which reliance was placed when making award. If it is later determined the Subcontractor rendered an erroneous certification, in addition to other remedies available to CNE or its entities, CNE may terminate the contract resulting from this Request for Proposal for default.

Currently Unavailable -- ELECTRICAL QUESTIONS AND ARCHITECTS RESPONSE: • What size is the new Electrical Service coming into the building? • Are there any specifications on the Panel? o On Page A1.0 the Note say Sleeve Electrical/ Sanitary Sewer/ Water for Future Service & Fixtures to 5’-0” beyond building as shown o On the scope of work it calls for conduit and wiring to be provided • Can you please verify what all of the requirements will be. ARCHITECTS RESPONSE A. A 400A, 480/277V, 3P, 4W Main Service switchboard mounted on the outside of the building adjacent to the service transformer. B. A 200A, 480/277V, 3P, 4W branch circuit panelboard located in the interior building electrical room. C. A 75KVA, 480V to 208/120V, 3P, 4W step down transformer located in the interior building electrical room. D. A 225A, 208/120V, 3P, 4W 2 section panelboard located in the interior building electrical room.
Currently Unavailable -- These are some questions that have been asked as of 1/28/14 and the answers: 1. There are no Electrical or Plumbing drawings. There is a stub out for a Toilet and an electrical panel. Do we use original drawings? There is an electrical panel location identified on the drawings so you can use the electrical conduit path from the old drawing. The toilet stub out is just 5 feet from the building to be installed in the future, same as the water stub out. 2. There is an interior wall, we need a detail on what the wall is going to be? The wall is a metal stud framed wall from floor to deck ½ inch drywall on each side.
